Acropolis a Go-Go
All nine restrictions against Acropolis, imposed by Common Council earlier this year, have been lifted. In an unusual turn of events, the owner of Acropolis, Paul Tsouflidis took his case all the way to the State Supreme Court, where it only took ten minutes for Justice Glownia to decide on the case. A public document was filed with Erie County Clerks Office yesterday (seen here). 

While the outcome allows Acropolis to move in a number of directions, I understand that a decision has been made to not build a bar on the second floor, mainly since the remodeling work has been completed and the restaurant is fully operational. At the same time, Acropolis now has the ability to play music on the second floor, which was one of the restrictions that frustrated Tsouflidis from the start. Acropolis will also have the right to have live music on weekends, just as The Blue Monk and Cecelia's (neighbors) do. 

I spoke to Tsouflidis after Common Council originally imposed the nine restrictions, but he never alluded that he would be taking the case to State Supreme Court. At the time, he did tell me that he was shocked and aggravated at the restrictions that had been imposed, and felt that a compromise could easily have been reached. Instead he apparently decided to fight the restrictions in order to (as he put it at the time) defend the rights of the small business owner. Tsouflidis told me that he felt that the voice of small business, whether it be restrictions on food trucks, 18+ age restrictions, etc, was non-existant and that local government did not have the right to create unjust laws at the behest of a handful of disgruntled people. Tsouflidis called the restrictions imposed upon his restaurant "An attack on all small businesses", and hoped that an eventual outcome (such as the one we see today) would serve as a lesson that there are ways to empower the Buffalo small business community, and one of them is to lead by example.

That is great to hear....just because of bunch of narrow minded A-holes and city government say that its against the law doesnt mean its true...It just shows how small minded and embarrassing our local govt is.....Please step back and let the business owners grow....Bunch of A-holes......

Great to hear! There are too many citizens in Buffalo who keep us from moving in the right direction. More competitive businesses are a win for everyone.

Couldn't possibly be that LoCurto and seven of his Common Council colleagues (all of them except Rich Fontana who smartly voted against it) incompetently far overstepped their legal authority by imposing new rules targeted at one business and not applying them to others.

No, of course that can't be it - [eye roll] - had to be that the City's lawyers couldn't well enough explain the Council's brilliant and fair reasoning to the court - lol

Joe EV, the relevant low quality involved was from the power drunk majority for that vote in the Common Council who apparently feel the rule of law can be anything they want to say it is.
LoCurto is even quoted Saturday in the Buffalo News still stubbornly trying to argue that the City should appeal the NYS Supreme Court ruling.

Even the best lawyers wouldn't be able to defend in court the Council's irrational overreach.

Congrats to Acropolis for standing up for their rights and prevailing over the Common Council, especially LoCurto, and over the nimbys and their control freakish cheerleaders.

Unfortunately for anyone trying to open a business, it's up to them to hire & pay for lawyers to go to court to FORCE the City to honor its own laws. ..."

This is one of those stories that should be told regionally and nationally ..... For one , it puts the A-holes on notice and 2 , it's a small win with bigger repercussions

I applaud Paul Tsouflidis for taking his case all the way to the State Supreme Court and doing so without placing a media spin on it. He kept things low key and fought for his rights. Classy. Now if we can just class up our City Government, because this was just a waste of everyone's time.
