One or More Idiots Vandalize Delaware Park

One or More Idiots Vandalize Delaware Park

On Saturday night, May 21st, the southern half of Delaware Park sustained significant damage due to vandalism.  The Marcy Casino building (199 Lincoln Pkwy) was the victim of graffiti on several of its columns and walls as well as the elevator for the handicapped.  The Ivy Bridge in Rumsey Woods was spray painted.  The decorative top of the ornamental fountain in the Rose Garden was snapped off.  The slide at the children's playground was maliciously destroyed by caving in its base and the top being tied up with rope.

IMG_0730.jpgEarlier in the evening more than 100 teenagers and young adults were witnessed congregating around the Marcy Casino.  The president and CEO of the Buffalo Olmsted Parks Conservancy, Thomas Herrera-Mishler, held a press conference today at 2:00 pm at the Marcy Casino to address this recent rash of vandalism.  Council Members LoCurto, Rivera, and Police Chief Barba were in attendance for the press conference.  Below are a few photos of the damage.

Those with information regarding the vandalism are asked to contact the Buffalo City Police tip line, (716) 847-2255, and or the Buffalo Olmsted Parks Conservancy, (716) 838-1249.

Good idea, but unlikely any serious jail time will happen for graffiti writers when it often doesn't even happen for conviction on robbery, burglary, etc.

Jails here are often overcrowded to the point of illegality (even though some people might insist the BPD hardly ever arrests anybody.... strange how that works).

Anyway, there have been a few well publicized cases of graffiti writers sent to jail here, but it seems very rare.

Wasn't there a case during the Herd of Buffalo exhibit where somebody vandalized one of the statues, which was considered a misdemeanor. From what I remember, the statue was later auctioned off to a company that paid enough money to qualify the damages to count as a felony.

Given the significance of the site, a judge may be able to determine that the damages are greater than simply cleaning paint off a wall.

The sad part here is that it was probably a kid who can't pay to repair the damages caused. And jail time would be minimally effective at preventing this in the future. I say sentence the kid(s) to community service with the parks department cleaning up their mess, any other graffiti that blights the city, and repairing other park amenities that need attention.

Has the city considered offering a reward? I suspect with 100 teenagers in the area, someone must have seen something and reward money may be more effective than appealing to their sense of civic duty (although hopefully one of them will step up and restore our faith in their generation). Also, any detailed information about the vandals "tags" (their grafitti street names) can help as others may know who this is. Looks like it says "Joey" on the column but difficult to tell from the photo.

I think this reflects the cities struggles with either political correctness, lack of man power, or will of those in charge. More and more I see riff-raff in areas of the city where they stick out like a sore thumb.

There are loitering laws, panhandler laws...etc. I'm not saying that any part of the city should welcome poor behavoir, however there are pockets of this city that people are investing heavily in. The criminals know this to they go where the money is.

How long as a business person or home owner can you pour money into and area with petti crime a prevelent factor and the occasional violent crime.

There are also long time stable neighborhoods, Love Joy, Parts of South Buffalo, University area that are at tipping points. There is limited incentive to invest, and the city seems to be reserved to the fact that absentee land lords and section 8 are the future for these areas.

It seems to me the police presence is directly reflective of how much the real estate cost. The pricer the neighborhood you never see a cop...go over the fillmore and they are everywhere. Every neighborhood in the city deserves some sort of presence. I sit on my GF front porch in parkside and watch people from clearly outside the neighborhood slowly walk down the street like they are window shopping. I've never seen a police car on her street ever. (upside is no alt. parking tix)

Rudy Guliani cleaned up New York by tackling quality of life issues first. Buffalo's stance on these issues seems to be...what do you want we have real crimes to address.

The city has some momentum in some areas its in Buffalo's best interest to help those who are putting their money on the line.

HAHA...ya know I was just thinking about this the other day. I used to live in Parkside (there have been a rash of home break ins/robberies there recently) and recently moved to Deleware. Never a single police officer on my street..odd? I see the same problems here on Deleware that I do off of Hertel..people that seem to be looking for trouble. (window shopping lol)

I'm sorry, but in an upper end part of town like Parkside (or Deleware)..I shouldn't have to deal with vagrants pushing shopping carts and gangs of youth with nothing to do...this is different than just going for a walk and enjoying the scenery in a part of town your not from. Where do you draw the line between profiling and prevention of wandering/protection of quality of life?

Can anyone tell me why the hell its legal to sell spray paint within City limits? Good god..8/10 taggers prolly don't have vechicles and wouldn't be able to bike out to Amherst or Cheektowaga to get some.. HEELLLOOO??

I can't tell you how many hoboes I've seen on Hertel in the last month...you can pee in public on Elmwood with no consequence. You'd be in jail for 10 years if you took a leak on Main Street in Williamsville..why not in the City of Buffalo? The disadvantaged aren't free to rome about where ever they like doing what ever they like.

I too have seen the graffitti under the bridge by the 198...why hasn't that been painted over either? Theres graffiti on Elmwood..I've seen in on Hertel. Heck..they tore down the building next to Burgios t.v. on main..and no sooner did the dump truck pull away was it already tagged..its unbelievable and the tag is still there!!!

What are the penalties for graffitti "artists"? More important..are there consequences for business that don't remove graffiti in a timely fashion? If this is such an issue..then maybe we should consider a graffiti friendly zone if this is art and the kids are bored?? Something to think about!

Call 311 or email 311@city-buffalo.com to report graffiti. I have found that the response is fairly quick and effective (usually within a week for public property, a bit longer for private property). In the last week, I was able to have an electrical junction box in my neighborhood painted over and a stop sign cleaned or replaced. There was a very large tag on a commercial building in my neighborhood, and an email to 311 quickly resulted in a letter being sent from the city to the property owner, and the tag painted over within a couple of weeks.

Complaining about it doesn't help nearly as much as notifying the authorities so the problem can be fixed.

Given the recent rash of crime in the Elmwood Village and the City's pledge not only in the last few weeks, but ironically today as well, to step up patrols, Delaware Park's high-profile screams foot/horse/bike patrols.
Given the nature of our community I know that all efforts will be made to correct what was done by these thoughtless kids, however I fear that the same efforts will not be put forth by those who have the authority and power to enfore order and protect not only our citizens, but our collective assests as well.

to some degree, yes. But most of the damage to the park was in areas away from the road. Nobody would have seen or heard them unless you were on foot walking through the park. Technically the park is closed at night anyway, so this is really more than can be expected from just ordinary citizens.

You are right that people should not just be spectators. But you can't expect ordinary people to patrol a (closed) secluded wooded park at 3am.

Vandalizing parks is just another example of the general lack of respect that is growing in many parts of the community.

It is also reflected in the "educational issues" and issues with youth in Buffalo and violence in entertainment districts. This lack of respect is exactly what teachers in many Buffalo schools are dealing with. I have friends who work in city schools and the students say "F-You" to teachers. I don't mean to get off topic but there is a bigger picture here that is a serious problem for Buffalo to advance.

I agree that this is a terrible thing to happen, not because it's in Delaware Park (the showpiece of the Olmstead system, and most used) but because it's a public space, and it was done to a playground and a public garden & building used by people from all over the county. Don't kill me, but I don't live in the city & I go the parks every week.
There's a couple key issues here: 1. where were the residents of the neighborhood when 100 people were gathered in the park (probabaly not being quiet or reciting Shakespeare), and how did it get to the point that nothing more was done? I know from my days working on an ambulance in the city that when it gets hot, people get restless, and rowdy and more bad stuff happens. So yeah let's shift the neighborhood patrols, but how about the neighborhood step up and take some ownership - they cearly have the financial capacity for it. 2. This is really a result of parents, families & neighborhoods not teaching character and responsibility. I'm not some old fart - I'm in my 30s - but I'd never have done something like this even in my rebellious years. So yeah we could arrest them, or we can give them community service, and maybe teach them to take pride in their city. I bet these kids also were from the neighborhood, or not far away, so maybe parents in the area should question why their kids have cans of spray paint, or smell like aerosol in the AM. And to the rest of us who just watch this idiocy happen - you're just as guilty as the knuckle-dragger with spray paint tearing apart the slide.

as others pointed out, it is very easy to do what you wish in the interior of the park where no one can see you. i don't consider it the responsibility of rumsey rd and lincoln pkwy residents to police the park at 3 am, though a trained and supervised volunteer citizens patrol is an interesting idea.

Dismayed, but not surprised. I rode through s. Delaware park on Sunday around dusk and thought how cool it was to see such a diverse collection people enjoying area: hipsters, skaters, couples, families, etc., I was pleased to see the activity and hope it continues.

Concerning the cretins, find them and put them to work cleaning up the parks -- hard, physical labor. No need to waste excessive funds prosecuting the twerps, just make them pay with lots of sweat and a bit of blood.

Community service does seem to be a sorely underused sentence. Show them the consequences of this kind of sociopathic behavior.

A pro-active zero tolerance graffiti policy in the Park and in the whole City could put the vandals on notice that jail time will be waiting when they choose to do stupid painting ...

This is a shame but nothing new, vandalism has been going on for generations. I can remember similar incidents back in the 60's and 70's. This isn't the fault of the city schools, parents, or police force. This is not a "city thing" either, vandals are also quite active in the suburbs and rural areas. The only people responsible for this are the little punks that did it, hopefully they will be caught.

They really need to increase the police presence at the park. I understand that it's impossible to patrol the entire park, but how about just the area around Hoyt Lake near the casino? I have witnessed many groups of kids hanging around in front of the casino, smoking pot, drinking beer, urinating in public, etc. I'm not talking very late at night (say 9:30-10:00), and by no means is it in a secluded area of the park. By allowing this to go on, it sends the message that nobody knows or cares what's going on in the park.

I agree, how about some sort of park patrol? Doesn't have to be a Buffalo Police Officer but something along the lines of a park ranger like a state park would have. Or how about a system in place to report unrurly behavior in park? Via text or phone, could go to police or whoever is in charge of park.

aaaaand...how many times did you call in reports of these people in the park that you've witnessed? Not intending to rule you out, but using this comment as an example.

Even with police patrol the We, the Us, the citizens that witness have a RESPONSIBILITY to report such events EVERY SINGLE TIME. The police cannot be there all of the time when needed. It isn't possible. WE are already there. Someone saw these kids doing this. Someone did. This kind of laxed thought process ("Let the govt. handle it; that's what we pay them for.") is greatly costing us our freedoms one-by-one on a daily basis with more and more cries from "us" for increased Govt. The laws already exist. Enforcement is the issue here, and not just by the police but by We The People.

And jail time? uhhhhh... has anyone noticed?...that alone doesn't seem to be working. That's because the solution is simple. There is no ONE miracle solution that fits the be-all-that-ends-all scenario. It is a more global change that is needed and less finger pointing. Hat's off to all of you mention community service. NO MORE NEED FOR THE CITY TO HIRE PEOPLE AT $50K/YR (as their second job) TO CLEAN UP AFTER ILL BEHAVIOR! Prosecuted people can do it free of charge. That, to me, is a no-brainer. A night in jail and 1,000 hours of community service with a ZERO TOLERANCE on excuses for not showing up. Show up ill, coughing, and feverish so that we can send you home. Why should anyone be put through that? Because when you INTENTIONALLY commit a crime you give up your basic human rights.

Also: People in the parks need to report. The people driving by need to report. The neighborhood needs to report. And the police need to report. All together at the same time AAAAALLL day long. To whichever category YOU belong: Get involved. Get your friends and neighbors involved. Involve the local police. Squeak until the wheels get fixed all over this great city! You do have time. You had time to comment here and on FB and at the end of every other article you've read today and in the passed week. So, you have time to get involved out there. And to some: Next time maybe consider picking up the phone to ask how you can help prevent such disastrous behavior in your neighborhood rather than to take your precious time letting us all know how witty and talented you are at putting people down, eh?

End of story.

Love!

And before anyone bothers to rebute: I am involved. I volunteer, even when I work fulltime, even when I'm off from chronic illness, even when I'm depressed and tired and bored with myself, and beaten down, and hating. (Did I leave anything out?) Together with my 9-yr-old son and his friend we raised $500.00 for Food Bank of WNY.

Power to the People!

Well said! Even if the city or the police may not have the resources to deal with every problem right now, they still need to know about them, so that there is pressure on them to fix things.

OUR COPS ARE LAZY. I live around the corner from the park and last week we had 30 cars broken in to. We NEVER EVER EVER have police on our street, but they are always at the pizza joint or the Mobil on the corner. We need police reform in this city, and until we get it, nothing will happen.

Apparently the zoo doors were left unlocked because there were monkeys everywhere in delaware park that night...over 100 of them doing what they've done to Chippewa, Elmwood and every other prospering area in buffalo...ruining it for everyone. They even have been knocking people out and robbing them on Elmwood in the village. 4 beatings and robberies in EV in last 2 weeks. Lock em up back in the zoo

Since the City of Buffalo Police cannot initiate more foot patrols due to manpower issues, here is a suggestion to the people of the Elmwood Village Society, Olmsted Conservancy. Why not call up the Buffalo Special Police? They are a fully insured, city chartered, all-volunteer police auxiliary. This is a no-brainer, especially when you have the people WILLING to volunteer their time to help the city.

The Special Police have many members who are fully qualified public safety officers and work as Corrections Officers, Sheriffs, Emergency Medical Technicians, etc. They have talked for years reutilizing them, as does the NYPD with there successful auxiliary. We could have them "walking the beat" in Delaware Park, on the Elmwood Strip as those extra eyes and ears.

Donn Esmonde's article has some more info from a witness:
http://www.buffalonews.com/city/columns/donn-esmonde/article435694.ece

Apparently it was done by a bunch of "clean-cut white kids, guys and girls" from Buff State. Sort of an evil flash mob.

I think they should find the Facebook event, and arrest everyone that responding "I Am Attending". Then put them to work for the rest of the summer cleaning the parks. No, sorry, you don't get to go back home to Long Island.

Thank you for posting this... as you can tell from some of the comments above, the immediate assumption by EVERYONE, myself included is that it was African-American hoodlums that did this.

Now... will anyone follow up on this?

Osiris>" immediate assumption by EVERYONE, myself included is that it was African-American hoodlums"

Huh? Osiris, which previous comments make any reference at all to race?
I notice only 1 person even hinting at it in duplicate comments he or she posted: yahoo.com/a/e0FRZJ8PxY73EY3T1lhZW0ji2IzU#69733

Out of dozens of comment writers, two people (yourself as you've admitted, and the yahoo) is far from "Everyone" making a racial assumption as you claimed. I gave no thought at all to race of who did this. Anybody who follows local news would be aware the last two times in this area when graffiti vandals were prosecuted enough to be shown in the media, they were white.

I don't see why it should make any difference what race or ethnicity the criminals are except as one aspect among many when witnesses identify suspects in a trial or to a grand jury... if it ever reaches those points.

"js">"arrest everyone that responding "I Am Attending". Then put them to work for the rest of the summer"

Is that cluelessness about what level of evidence is needed for arrests & convictions, or just a desire for the city to have to pay out $$$ after losing a bunch of false arrest law suits?

Neither, just a tongue-in-cheek comment (although I do think they should find these young adults and sentence them to significant community service).

I was in the Japanese gardens around 1:30 am walking my dog on this date and I saw tons of kids hanging out there. The police had 3 cars that drove down Nottingham terrace with their spot lights directed into the park. This of course sent kids swarming in all directions. I'm wondering why no one was caught even though there were police in the area?

The "kids" I saw were all college like in the 18- mid 20s range. It was a very mixed group of black white and even asian young adults. I yelled at a large group of them that were using mirror lake as if it were a large trash bin by the willow tree.

Today is International Yarn Bombing Day. Can we get any creative knitters to 'vandalize' the city with fabric instead of spray paint?

http://yarnbombing.com/

Some great photos on that site... yarn bombing is basically adding kitted, crocheted or fabric 'graffiti' in places you'd least expect it. It's temporary, colorful, and doesn't leave any permanent damage!!
