102 Johnson Park Eulogy

It is disheartening that I find myself writing to eulogize a building that has been unnecessarily allowed to become a victim of neglect; especially one in a much sought-after location such as Johnson Park. I am, of course, making reference to 102 Johnson Park (see back story) that has been coerced into playing the role of an unwanted child whose eventual fate will be urban vandalism.

David Torke, of Fix Buffalo, periodically quotes the "Broken Window" theory where one broken window, left unrepaired, will lead to a multitude of broken windows, vandalism, urban blight, and eventual demolition tearing away yet another piece of fabric from the community.

The boarded-over front entrance with "Order to Vacate the Premises" stenciled in red letters is a far more deadly parody of David Torke's theory in so much as it is shouting an invitation for further violation of this property.

Compounding this tragedy is that there has been a conscientious effort by the community and Buffalo Rising to prevent this from happening. However, due to unenforceable housing inspection citations and an owner who refuses to relinquish his stranglehold on this property, we may possibly lose another architecturally significant building in one of Buffalo's more unique areas.

Rhetorical questions; how do we prevent a potential sad farewell to a 124-years of history whose demolition will reverberate throughout the neighborhood but will be meaningless to those who may pass-through and gaze upon an empty lot and murmur: "A house actually stood on that narrow lot?"

What part of an individual's psyche allows them to neglect their property without any personal accountability? Even a slumlord has a motivation and that is to simply make as much money from their property with little to no maintenance.

Chuck Dobucki is, indeed, a paradox in regards to 102 Johnson Park as the house is no longer legally habitable, but yet, he continues to pay property taxes and nothing more.

I would almost entertain the notion that he may have some form of sentimental attachment to the house as his mother once owned it. However, wanton neglect negates that theory and, if the problem is monetary, than why not just sell it as we all know the property will catch a fair price even in its present condition.

There is a fine line between community property management standards and violating homeowners civil rights but when the owner neither resides nor even rents the property, there has to be some form of legalities that can prevail without being abusive. Perhaps there is no adequate form of checks and balances and we are simply left to deal with an individual whose attitude is screw you.

It's time to drag this owner to housing court, and have the house taken away from him. Have someone from Permits and Inspections file the case with Judge Nowak before he leaves for his newly elected role. I'm in the process of doing that with 2 owners in my neighborhood and while it's not easy, its certainly not as difficult as I thought it would be.

I believe in the back story the house was put up for sale at around 95,000 when the actual worth of the house was about 65,000.

It would be helpful to have neighborhood activist Marilyn Rodger's current perspective on this sad saga. She can be reached at Marine Dr. Apartments, where she is (interim) manager.

Dobucki has long had three cases in Housing Court, having last appeared Oct 19, his next hearing Dec 1.

Unfortunately, Nowak's imminent deparure from Housing Court is likely to further slow any action on this case

This story seems very self serving to me. I get the feeling that Mark Williams is harassing Chuck Dobucki by writing this article as well as others I have seen on the internet because he himself is interested in purchasing this property.

No, I am representing the Johnson Park community and an area that I personally believe represents a unique piece of Buffalo history.

You are correct, this problem is across Buffalo but it should not be happening in this particular neighborhood nor did this house just become a problem, it has been a problem for several years.

If you like, I will begin a campaign for 94 Northampton....

dont let anyone tell u Dobucki has no $. he has owned several houses in the city. I know of at least one he sold 4 a very handsome profit, that house also never a cert of occupancy while he owned it.

It's busy bodies like you who make life miserable for your neighbors. Who anointed you architectural police of the neighborhood? Has it ever occurred to you that the people you're blowing in to housing court may be aware of their violations, or may simply not have the resources to deal with them right away? Did you speak to them directly or take the cowardly route of going straight to the city?

Care to tell us what neighborhood you're in? Many of my friends in Allentown have been ratted out by neighbors like you with nothing better to do than meddle in the affairs of others. Perhaps you're the one responsible.

Get a life, and mind your own fu-king business while you're at it!

Oh here we go. Listen "godismakebelieve"... there are laws established in the city charter that dictate what is acceptable and what is not. Those of us in the neighborhood know when someone is making a good faith effort to make changes and repairs to the properties they hold, and those who are contributing to demolition by neglect. This guy has (as evidenced by the laundry list of appearances in court) been given numerous citations and chances to make corrective actions to this property. Many of us have invested a lot of money and years into making these neighborhoods better, and to sit back and NOT be proactive by using resources like 311, housing court, permits and inspections would just be plain lazy. This guy is *NOT* interested in fixing the house, but in selling it at a hugely inflated price not in line with what its actually worth. Its the "busy bodies" who keep people like him from bringing neighborhoods down with their utter disregard for those of us who genuniely LOVE our street. Say what you will, I personally do not go out of my way to make peoples lives miserable. I simply hold people accountable for their actions (or in this case, their inaction). If someone cannot afford to make the repairs to the house, or get it up to code, they probably should not be in posession of this property. Plain and simple. Sounds like you have a HUGE chip on your shoulder regarding people who want to make and KEEP our neighborhoods livable and attractive.

To the rest- These articles are great. In fact, I'd love a feature article every week on a different property owner doing the same thing on a different street every week. It puts a name on the blight that most of us drive or walk by on a daily basis. Mark- keep on this guy and on similar stories. People like me with money invested in neighborhoods like this really do appreciate you drawing attention to these criminals, and thats exactly what this man is.

I haven't liked these postings. It is very similar to the guy a couple weeks ago that can't sell his parents house because of the uncertainty around the peace bridge plaza.

There should be a forum for these type of grevances because they relevant to what is going on in Buffalo. But there should be a distinction between these posts and the ones from WC, ect.)

I don't think it's a bad thing to make this owner be accountable even if it is for selfish reasons. The owner's gross negligence of this property in a historic neighborhood should have some consequence as it does have direct effects on the neighboring properties. If I had the funds I would buy it and make the renovations myself. There are plenty more properties sitting vacant that I would take in a heartbeat but they're not for sale. I do also believe the owner should be approached personally before taking anything to housing court. Maybe he will be more willing to negotiate if he does not need to be on the defense. If anyone has the money to buy this and looking for a partner to take on the work let me know, I'm willing and capable.

I am not sure I understand. Why wouldn't the neighbors of this property want this exposure of a negligent owner? His actions only hurt the area....

Chuck "Charles" Dobucki grew up in Tonawanda so he does not have any genetic connection to the city or this particular neighborhood. He is(?)/ was a realtor and you could make a case that he is not acting professionally and certainly not acting with the best interests of the city in mind. He is a part of the "aesthetic" community and should, well, just know/act better. Regardless of all things, including his financial circumstances, he must not be allowed to negatively effect the neighboring properties, Johnson Park, or the city. When someone is in over their head, or otherwise can't interested in maintaining a property to the law and codes, a swift remedy to correct or sell must come into play.

This is the 3rd post about this property. The owners name is being tossed around pretty random. Seems to me in the past if a poster used names in a thread they were deleted. What is happening with this property is a pity, but is this more about a personal vendetta from the author with Chuck? Amazing what BRO picks and choses to publish/delete.
