North Buffalo Trash Talk
What would you do if a restaurant (local or national) was going to move just a few doors down from you and it wanted to place a garbage shed in front of its business? Let's say that the garbage shed was to be positioned on the 'residential right of way' instead of on the commerce-side of the building. With the compliance of the operator, I would think that a mutual agreement could be arranged between the neighborhood, the business and The City. Often times when a restaurant moves into a formerly non-restaurant space, these problems can, and often do, arise.

This is the scenario that neighbors living on Wellington Avenue in North Buffalo are facing. Apparently the business in question is a Subway restaurant - a business that has had a spotty track record in this city at best. Remember the corner of Elmwood and Forest? I wouldn't have wanted to live near that business with all of the garbage that accumulated on a daily basis - they were not good neighbors. Then again, it's not a KFC. Frankly I have nothing against chains, and even encourage certain ones to open in Buffalo. That's not the issue. The issue is quality of life for the neighbors, and if this city had updated zoning requirements for these types of conundrums, then we wouldn't even be discussing this right now. Following is the lowdown from resident Dan Ryan who is concerned that The City has not done its due diligence when it comes to handling the garbage issue.

Dan states that,

"Ideally they would partner with the business across the street for the shared use of their dumpster, or perhaps store their totes in the City owned lot across the street. The fact that there is no place on their property to store their garbage makes the site unsuitable, but our argument is that if they must locate there, have their commercial refuse on the commercial side of the property, not the residential.

"The Subway restaurant chain has plans to open a location at Hertel & Wellington in North Buffalo. While there is general opposition to bringing what some call a "strip mall franchise " to a district of thriving sole proprietorships, opposition has galvanized around efforts by the chain to build a garbage shed on residential right of way on Wellington Road adjacent to the property.  The City Planning board at first tabled the measure urging the franchise owner to meet with neighborhood residents to share architectural drawings of what was promised to be an "attractive garbage enclosure". Two weeks later the board approved the garbage shed without the neighborhood having input.

"A petition opposing the construction of the garbage shed on Wellington with close to 300 signatures of neighborhood residents, business owners and patrons of Hertel shop was shared with the Planning board and with Councilmember LoCurto. The residents are requesting that if the restaurant is to be allowed to store their garbage on city property, that they be stored on the Hertel side, next to the totes that are already stored there by the adjacent neighbor - North Park Florists. To date there has been no public hearing on this issue.  Those who are opposed to giving up city right of way on a residential street for the construction of a garbage shed are being urged to contact Councilmember LoCurto at 716-851-5155."

Garbage tote issue aside since I don't live in Wellington, I live in this neighborhood and have no problem with this 'strip mall franchise' moving in as long as they run a clean operation. You want to talk about garbage, take a walk by Del Denbys (next to Kostas), the curb is littered with cigarette butts in front of this place all the time, there are a couple other sole proprietors who seem to have similar issues. I'm mostly anti-franchise and big box, but this is the biggest fast food franchise in the world, and its not like they are building a strip mall on Hertel, or will take away from the street.

there's a new subway opening at main and court in the former radio shack. they're landlocked, too. where is their garbage going to go?

surprisingly, that former Radio Shack is actually not landlocked. There is a rear entrance (and even a few parking spaces) accessed from Pearl. You never notice it from the street, but it's there and it's bigger than you'd expect. Use Bing with the address of 454 Main Street and satellite view and you'll find the drive sandwiched between the Liberty Building and the Courtyard Mall food court, which 'L's around the courtyard.

thx for the info. i figured there must be something on pearl but the backside of the mall is so unpleasant that i never wanted to look that closely.

Next time you're downtown, do yourself a favor: go around to the Pearl Street side.

Next to the Liberty Building is a smallish driveway. Immediately after that drive is an entrance for the Courtyard Mall's Food Court. Go down that driveway. If anyone should stop you and ask where you're going (and they won't), just explain you're with a small company looking for some office space and you'd heard that there was space available above the former Radio Shack, and you were just scoping it out from the back. They won't ask any more questions, except if they're the owner and want to rent you space, in which case play along. Don't reveal your company. Claim you don't have a card with you, and you prefer not to name the company yet because you're just bird dogging property for your boss and it's premature. Give your real name or make one up (just like this blog). Maybe he'll show you the office space. But in reality, you won't meet anyone and you won't be stopped. Just walk around the back yard like you own the place.

For some reason, I like seeing that space that the driveway opens up into. It's completely hidden and completely utilitarian. It gives access for deliveries and garbage and even a bit of parking, and no one would ever know it's there. it's a nice bit of functional space usage.

Good question. I have no problem with a chain as long as it respects the historic buildings and urban character of their neighborhood. It just sounds like a design solution...

Also what does the residential right of way mean? The general public ROW for everyone? Are they putting it on the curb on Wellington? On the backside of their building facing the house behind them? If you are going to come up with new jargon you need to define it a little better.

Yea, not really sure what the meant either? I mean it cant be impeding on the sidewalk?
The article mentions them sharing a dumpster with the business across the street as well. I can only imagine La Marina sign the petition, so why on earth wold they share a dumpster.

I am wondering if this information has been verified??
I have been told that the owner, a North Buffalo resident, has contracted with a private company to pick up trash 3 times a week. I also believe that the owner did arrange a meeting with residents, but not all showed up.

A lot of non-standard terminology being used. Garbage shed? Do they mean a dumpster enclosure? Problem in the Buffalo area: dumpsters are usually exposed or behind picket fences, where in the rest of the country, masonry screening is the norm.

Not everyone shares Dan's opinion. I live close to where the new Subway is opening. After talking with Councilman LoCurto I feel assured that the gentelman who is opening the Subway is a reasonable man. I can't even imagine a business crossing the street to throw out garbage. The owner will be using totes, and if he has made arrangements for a company to pick up the trash 3 times a week, I feel satisfied with that arrangement. I feel that LoCurto has dealt with the situation in a fair way, there won't be a dumpster on that corner like many of the restaurants do use.
There is no backyard, no side area for totes to be placed.

The owner want to put the garbage in some sort of shed enclosure on the sidewalk on Wellington. As the picture shows, the Florist next door stores their totes on the commercial right of way - inches from the proposed Subway. The consensus of the neighborhood is that while these totes are unsightly, it is preferable to have them stored on Hertel than on Wellington. There is a home on the Northeast corner that would have to look out their front window at garbage 365 days a year. Unfortunately, without a public hearing there has been no way for the neighborhood to share their views except through petitions which seem to have been ignored so far.

There was a "meeting" scheduled, but it was held the week between Christmas and New Years, and the invitations were laying on peoples porches next to a few Metro Community News bags. Oddly enough, few people attended.

kind of off topic, but why doesn't every bar have to have a cigarette receptacle outside? with the snow thaw this spring it is absolutely disgusting to see all of the cigarette butts that have been thrown to the curb outside of bars along elmwood and hertel over the winter.

why is it that smokers are allowed to litter? it's not as if cigarette butts decompose within a year. it would be nice to see buffalo, and the u.s. in general become tougher on cigarette litter.

The garbage totes are unsightly whether on Hertel or Wellington, whether a florist or a restaurant uses them. THAT is the real issue. The City or the Hertel business association needs to address this issue. Similarly either entity needs to get shop owners to sweep and shovel regularly as well as tend to their properties properly. Dirty streets will always lead to fewer customers.

I think the totes on Hertel Ave are more unsightly than a well designed storage container for them on Wellington... then again there are no images or drawings of what the Wellington enclosure would look like so it is hard to compare.

The best solution would be the use one or two parking spaces in the Family Video lot for an common tote enclosure for the whole block. That parking lot is never, ever even half full. It would be nice if a couple of the spaces could be spared for this use. Especially since most of it doesn't serve any purpose at all now.

I'm with LovinLivinintheBuff... There should be NO rubbish bins of any kind on any street. Keep it inside until night when the trash pickup happens. It looks horrible no matter what type of business..

Sean - I can't believe you are suggesting that the FV parking lot is never even half full. Check it out at night and especially on weekend nights. The parking lot is being used for all of the nearby businesses (as well as an apt across Sterling, which I am sure is illegal). The traffic coming thru the lot is ridiculous - and - according to my own very unscientific poll (counting cars as I sit on my porch), 95% of cars ignore the NO RIGHT TURN sign, and turn onto Sterling anyway. It is infuriating. There is even a parking attendant there on Fri/Sat nights!! He watches people park in the lot and walk to the bars!

Regarding the trash: There is a small enclosed dumpster for FV. I cannot imagine a restaurant sharing it - it already causes problems b/c they leave it open, and there are receipts and papers everywhere.

I am so disappointed that this Subway is even a possibility. We need a good, locally owned deli and/or coffee shop or something that reflects the wants/needs of the neighbors. Subway is not exactly what we need here.

Come on, people! There must be a way to keep this chain away from Hertel! FV is bad enough - attracting all sorts of people who are not even from this neighborhood...it's really too bad that we are not informed in advance or listened to when we speak out. Just another problem with Bufflao politics.

Hertel Ave is full of locally owned business, I can't comprehend why a Subway franchise in this location is a big deal, especially since it will be locally owned...
I live a couple blocks over and am a FV customer, I haven't taken my own unscientific poll and asked all the patrons which neighborhood they live in however.
